1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Aussie Rights Kit mobile application, the website at keepthemhonestau.com, and the web platform at keepthemhonestau.app (collectively, "the Service"), which is operated by Keep Them Honest AU ("we", "us", or "our").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not access or use the Service. Your continued use of the Service after any updates to these Terms constitutes acceptance of the revised Terms.
2. Description of Service
Aussie Rights Kit is a free legal rights education app designed for use across all Australian states and territories — New South Wales, Victoria, Queensland, Western Australia, South Australia, Tasmania, the Australian Capital Territory, and the Northern Territory.
The Service provides:
- Plain-English summaries of your rights when dealing with police, at protests, during traffic stops, and in other common encounters
- An AI-powered Police Encounter Simulator for educational practice
- An AI Educator that answers questions about Australian legal rights
- State and territory-specific legislation references
- An Emergency Plan tool for storing emergency contacts on your device

3. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you should use the Service with the involvement of a parent or legal guardian. By using the Service, you represent and warrant that you meet these age requirements and have the legal capacity to agree to these Terms.
If you are accessing the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
4. Use of the Service
Permitted uses. You may use the Service for personal, non-commercial educational purposes, including:
- Learning about your legal rights in Australia
- Practising interactions with law enforcement using the AI simulator
- Storing emergency contact information on your own device
- Sharing links to the Service with others for educational purposes
Prohibited uses. You must not:
- Scrape, crawl, or systematically extract data or content from the Service
- Represent or present any content from the Service as formal legal advice
- Use the Service to plan, facilitate, or carry out any unlawful activity
- Attempt to disrupt, overload, or gain unauthorised access to the Service or its infrastructure
- Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service
- Use the AI features to generate content that is unlawful, defamatory, harassing, or harmful
- Resell, sublicense, or commercially redistribute any content from the Service without our written permission
- Use automated scripts, bots, or similar tools to access the Service
You are solely responsible for your use of the Service and any content you submit through the AI features.
5. Intellectual Property
All content provided through the Service — including text, summaries, legislation references, graphics, logos, and software — is owned by or licensed to Keep Them Honest AU and is protected by Australian and international intellectual property laws.
You may:
- View and use the content for your own personal, non-commercial education
- Share direct links to the Service with attribution
You may not:
- Reproduce, republish, or distribute the content commercially without our prior written consent
- Modify, adapt, or create derivative works from the content
- Remove or alter any copyright, trademark, or attribution notices
- Use the "Keep Them Honest AU" name, logo, or branding without our written permission
Legislation referenced in the Service remains the property of the Crown and the respective Australian parliaments. Summaries and explanations of that legislation are our original educational content.
6. AI-Generated Content Disclaimer
The Service includes AI-powered features (the Police Encounter Simulator and AI Educator) that generate responses using third-party language models. AI-generated content may contain errors, omissions, or outdated information.
- AI responses are generated in real time and are not reviewed by a qualified legal practitioner
- AI content is not legal advice and must not be relied upon as such
- AI features may occasionally produce inaccurate, incomplete, or misleading information
- You must always verify any information with official sources, such as legislation published on legislation.gov.au or the website of your state or territory police service

7. Third-Party Links and Services
The Service may contain links to third-party websites, resources, and services that are not owned or controlled by Keep Them Honest AU. These may include:
- Links to official legislation and government websites
- Links to legal aid services and community legal centres
- Third-party AI providers that power the AI features
- Google Play Store for app distribution
We have no control over and assume no responsibility for the content, privacy practices, or accuracy of any third-party websites or services. You acknowledge that Keep Them Honest AU is not liable for any damage or loss caused by your use of any third-party website or service. Review the applicable third-party terms and privacy policies before using them.
8. Disclaimers and Limitation of Liability
Educational purpose only. The Service is provided strictly for general informational and educational purposes. Nothing in the Service constitutes legal advice, and no lawyer-client relationship is created between you and Keep Them Honest AU.
No warranty. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that the information is accurate, current, or complete.

9. Indemnification
You agree to indemnify and hold harmless Keep Them Honest AU, its operators, affiliates, and contributors from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or relating to:

- Your violation of these Terms
- Your violation of any applicable law or the rights of any third party
- Any content you submit through the AI features
This indemnification obligation survives the termination of your use of the Service.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
You submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any dispute arising out of or relating to these Terms or your use of the Service. Nothing in this section prevents you from seeking remedies available under Australian consumer law where applicable.

We may update or modify these Terms from time to time at our sole discretion. When we do, we will revise the "Last updated" date at the top of this page. We encourage you to review these Terms periodically.
Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service. For significant changes, we will make reasonable efforts to notify users through the app or website.
